Official Rules: FailedNeighbor Amazon Gift Card Giveaway

NO PURCHASE IS NECESSARY TO ENTER OR WIN. ENTRY INTO THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE RULES. VOID WHERE PROHIBITED.
In order to be eligible to win one of the prizes or participate in the Contest, you must have submitted a photo, video or story that is accepted by the moderators of the site and you must “Like” FailedNeighbor’s facebook page using either the “Like” button on FailedNeighbor.com or going to FailedNeighbor’s facebook page. You may enter as many submissions as you like; however, you will only be registered to win after you first “Like” FailedNeighbor on Facebook. The contests officially starts November 8th, 2011 and a winner will be declared January 31th, 2012 unless the contest fails to reach the minimum number of 55 submissions.
1. ELIGIBILITY
To be eligible to enter the Amazon Gift Card Contest (hereinafter, “Contest”), you must have (i) submitted a story, video or photo to FailedNeighbor.com’s website and “liked” FailedNeighbor on Facebook (ii) be above the age of majority in the jurisdiction in which you reside at the time of entry. By entering the sweepstakes you are confirming you are sixteen (16) years of age or older. Employees, officers, directors, and contractors of FailedNeighbor, its agents or affiliates, advertising or promotional agencies, and their immediate families and those living in their households, are not eligible to participate in the Contest. Void where prohibited. All federal, state, and local laws and regulations apply.
2. TERM
The Contest begins at 12:01 a.m. Eastern Standard Time (EST) on November 8th, 2011, and ends at 11:59 p.m. EST on January 31st, 2012 (“Term”), unless the contest fails to reach the minimum number of 55 submissions.
4. TO ENTER
NO PURCHASE IS NECESSARY TO ENTER OR TO WIN. During the Term, to enter the Contest, (i) visit the FailedNeighbor website, submit a story or photo or video, and “Like” us on Facebook.
Note: It is entrant’s sole responsibility to ensure that they have successfully submitted their information and registered to win in the contest. FailedNeighbor will send an confirmation email within 48 hours of officially entering the contest.
LIMIT: ONE (1) “LIKE” ENTRY PER PERSON; HOWEVER YOU MAY ENTER AS MANY STORIES OR PHOTOS OR VIDEOS AS YOU LIKE UNDER THE SAME NAME FOR A GREATER CHANCE TO WIN. Entries are limited to one (1) “like” per Facebook profile and one (1) vote per person. Use of any automated system and/or proxy servers to participate (i.e. voting for your submission multiple times via a proxy server or program) is prohibited and will result in disqualification. FailedNeighbor is not responsible for late or misdirected entries, or for any computer-related, online, telephonic, or technical malfunctions that may occur. By entering, you agree to be bound by these Official Rules. If you are entering on behalf of your employer, these rules are binding on you, individually, and your company. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the Facebook profile.
The “authorized account holder” is the natural person whose name is on the Facebook Account. A selected entrant may be required to provide FailedNeighbor with proof that he/she is the authorized account holder of the Facebook Account associated with the selected entry.
5. WINNERS
Only winning entrants will be notified directly. Notifications will be made via e-mail. After the Term, FailedNeighbor will be awarding the following Prizes:
Prizes: The first place prize winner will be selected by the most Facebook Likes to receive a $75.00 Amazon Gift Card. Total MSRP: US$75.00. The second place prize winner will be selected by the second most Facebook Likes to receive a $25.00 Amazon Gift Card Total MSRP: US$25.00.
All decisions on all matters pertaining to the Contest are final. Winners are responsible for any and all taxes. Amazon gift certificates are delivered via email only, so winners must have a valid email address. FailedNeighbor reserves the right to substitute a prize of equal or greater value. Limit one prize per person, family, or household. Odds of winning depend on the number of eligible entries received. If a winner is a subject to the U.S. tax law (U.S. citizen or U.S. resident), he or she must complete and submit to Sponsor IRS form W-9 prior to receiving the prize.
6. WINNER NOTIFICATION
The selection of the winner will occur on or about January 31st, 2012, from among all eligible entries received. Winners must be listed as a fan at the time of the actual drawing. The potential winners will be notified through Facebook on or about January 31st, 2012. Potential winners will have fourteen (14) days from notification to claim their prize. FailedNeighbor and its affiliates, subsidiaries, employees, contractors, agents, officers and directors, advertising and Contest agencies, and their respective officers, directors, employees, and their respective agents will not be liable for unsuccessful efforts to notify a winner. No prize transfer, assignment, or substitution by winners permitted. FailedNeighbor may substitute the prize for one of equal or greater value. All federal, state, and local taxes, fees, and surcharges on prizes are the sole responsibility of the winners. Winners may be required to complete a release and provide tax identification or other information prior to receiving their prize. If any potential winner declines the prize, fails to claim the prize, is unavailable for prize fulfillment, fails to abide by the Official Rules, or is ineligible, Sponsor may select an alternate winner from all remaining eligible entries. If any prize or prize notification is returned as undeliverable, that prize is forfeited and FailedNeighbor may select an alternate winner from all remaining eligible entries.
7. LIMITATION OF LIABILITY
FailedNeighbor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Contest.
By participating, entrants and winners release FailedNeighbor, its affiliates, parent, and subsidiary companies; its employees, agents, and officers; and its advertising and promotion agencies, as well as all others associated with the development and execution of this Contest, from and against any and all liability with respect to or in any way arising from the Contest and the awarding and use of the prizes. FailedNeighbor assumes no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; or alteration of entries.
Participants also agree (a) to be bound by these Official Rules; and (b) that the decisions of FailedNeighbor are final on all matters relating to the Contest. Winners agree to be bound by these rules and the decisions of FailedNeighbor, whose decisions are final and binding.
If you are acting within the scope of your employment, as an employee, contractor, or agent of another party, you warrant that such party has full knowledge of your actions and has consent thereto. You further warrant that your actions do not violate your employer’s or company’s policies and procedures.
8. LAWS
This Contest is governed by the laws of the State of Ohio, USA, without regard to the conflicts of law provisions.
9. WINNER(S) LIST
To obtain the names of the winners, send a email to FailedNeighbor.com with the subject line “WINNER(S) LIST”. You will be required to sign a confidentiality agreement prior to receiving the winners list.
